EU Responsible Person for Etsy Sellers: What It Is and How to Get One

Of everything in the EU's General Product Safety Regulation, the "Responsible Person" requirement causes the most confusion among Etsy sellers. It sounds like hiring a lawyer, it sounds expensive, and half the explanations online contradict each other. Here's the straightforward version: what a Responsible Person is, what they actually do, who can be one, and how to sort it out for your shop.

What the Responsible Person actually is

Under Regulation (EU) 2023/988, every consumer product placed on the EU market must have an "economic operator" established in the EU who takes responsibility for product-safety tasks. In plain terms: the EU wants a real name and address inside the EU it can contact about your product. That contact is the Responsible Person.

Etsy's GPSR FAQ lists the duties: maintaining the product's technical documentation and handing it to authorities on request, making sure labelling and traceability information is correct, informing authorities about dangerous products and accidents, cooperating with authorities, and making sure corrective actions happen. It's a genuine legal role — not a rubber stamp, and not something a PDF template can provide.

Who can be your Responsible Person

The regulation gives you four options, in order of preference. You need one of them, established in the EU or Northern Ireland:

  1. You, if you're based in the EU/NI. An EU-based manufacturer is their own Responsible Person. Nothing to appoint, nothing to pay.
  2. Your importer. If someone imports your products into the EU and sells them on, they can take the role.
  3. An authorised representative. This is the option most non-EU Etsy sellers use: a company in the EU that you formally mandate to act as your Responsible Person. It's a paid service.
  4. A fulfilment service provider. If none of the above exist, your EU fulfilment partner can fill the role.

For a typical US or UK Etsy seller shipping directly to EU buyers, option 3 — an authorised representative service — is the realistic path. Etsy has partnered with third-party providers (they name Cert-Rep and International Associates in their FAQ) that offer exactly this, and independent providers exist too. Expect a subscription-style fee; it's the one real recurring cost of GPSR compliance for small sellers.

Where the details go on Etsy

Etsy's listing editor has dedicated fields for the Responsible Person's name, postal address, and electronic address on EU-facing listings. Beyond the listing, the Responsible Person's name and contact details should appear on the product, the packaging, or an accompanying document. Most handmade sellers put it on the packaging or a product insert card, since engraving it on every handmade item isn't practical.

Don't confuse the Responsible Person with the manufacturer details. Your manufacturer block (your name, address, email) is always required. The Responsible Person block is additional — it's the EU-based contact. Both appear on EU-facing listings.

What it typically costs

Authorised representative services generally charge an annual or monthly subscription. Prices vary by provider and product category, but for a small seller it's typically a modest yearly fee — the kind of cost you absorb across your EU sales. Be wary of two things: providers offering a "certificate" instead of an actual mandate agreement (a certificate isn't the role), and prices that seem too good to include real documentation handling. The provider must actually keep your technical documentation available for authorities — that's the job.

Do you even need one? Check first

Before you pay for anything, confirm the requirement applies to you. EU-based makers don't need to appoint anyone. Sellers who've excluded the EU and Northern Ireland from shipping don't need one either. And digital-only sellers are outside the practical scope of the physical-product rules.
